In this activity, we will look at the requirements to form a contract. We will also have the opportunity to read a sample complaint
Read the Complaint for Breach of Contract downloadthat was filed in the Star v. Baher case. Answer the below questions in your own words (and to the best of your ability – it doesn’t have to be perfect). Then, upload your answers to Canvas as a .doc or .docx file.
In answering these questions, assume that the legality and capacity requirements are fulfilled.
1.Was there a valid offer? Explain.
2.Assuming there was there valid offer, was there valid acceptance? Explain.
3.Assuming there was valid offer and acceptance, has each party provided the requisite consideration? If so, what is the consideration for each party?
4.Do you think there was a valid contract? Why or why not?
5.Assuming there was a valid contract, is it a unilateral or bilateral contract? Explain
6.Assume there was a valid offer made and the consideration requirement was met for each party. If, on the night of January 7, 2013, Mr. Baher contacted Mr. Star and said “I actually don’t have $5,000,000, so my offer to pay you $5,000,000 is revoked,” but Mr. Star still sends the acceptance letter and a copy of his birth certificate on January 8, 2013, would there be a valid contract? Explain.
7.Assume there was a valid offer and consideration. If, on the night of January 9, 2013, Mr. Baher contacted Mr. Star and said “I changed my mind and I don’t want to pay you $5,000,000, so my offer to do so is revoked,” but Mr. Star had already sent the acceptance letter and a copy of his birth certificate on January 8, 2013, would there be a valid contract? Explain.
8.Assume there was a valid offer and consideration. If, at 12pm eastern on January 8, 2013, Mr. Baher mailed a letter to Mr. Star that stated, “My offer to pay you $5,000,000 is hereby revoked.” At the exact same time (at 12pm eastern on January 8, 2013), Mr. Star mailed the acceptance letter and a copy of his birth certificate.
